EFCC Freezes Gov Fayose’s Account | Says Immunity does not Prevent Investigation of “Suspicious accounts”

The Economic and Financial Crimes Commission (EFCC) has frozen the account of the governor of Ekiti State, Ayo Fayose, saying that they are investigating suspicious movements of money into his account.

Governor Fayose announced the restriction on his account via his twitter hand on Monday. He said:

The governor in a press release by his Chief Press Secretary, Idowu Adelusi said that some leaders of the All Progressive Congress (APC) and a prominent Ekiti lawyer were the brains behind the restriction.

The statement made available to PREMIUM TIMES read:

Section 308 of the 1999 Constitution gives me immunity just like the President. I wouldn’t know why these people are intolerant of others and in a haste. Let them wait till 2018 when I will end my tenure for them to do their investigati‎on. The other time the EFCC accused me of embezzling N1.2 billion poultry project fund, I was the one who voluntarily reported myself to the EFCC.

It was ‎when I got a hint of their move that I wrote a cheque to withdraw some money from the account and I came myself. I was denied access to the account as I was told the EFCC has placed restriction on it. That is executive rascality taken too far. Even when I had case with EFCC my properties were not affected.

If they say they are investigating money spent on election, does it mean it is only Peoples Democratic Party (PDP) that spent money on election? A lot of people and groups supported my campaign then. Where did APC and their leaders get the money they spent on 2015 general elections from? Now it is only in PDP that they find thieves, to them there are no thieves in the APC.

A lot of petitions were written against former Governor Kayode Fayemi and the EFCC has not asked him a question up till now. The diversion of N850 million fund meant for Ekiti State Universal Basic Education Board is there and nobody is asking Fayemi questions.

Even the President cannot claim to be an angel. The estate he built in Abuja is known to us. His wife was indicted over the Halliburton Scandal. When that American, Jefferson, was being sentenced, the President’s wife was mentioned as having wired $170,000 to Jefferson. Her name was on page 25 of the sentencing of Jefferson. We can serialize the judgment for people to see and read.

We will not allow this and we will defend our rights within the law of the land.

Those who th‎ink they can silence me are mistaken. I am a person who is not perturbed by things like this. Let them wait till 2018 when I will finish my term and I will be the one to go and meet them. I won’t run away and let them investigate the whole world, I have nothing to hide or fear.

According to Vanguard, the EFCC, reacting to the claim that he cannot be investigated as a result of his immunity as a sitting governor, through its spokesperson Wilson Uwajaren said that:

“Immunity does not prevent EFCC from investigating suspicious accounts of those enjoying immunity and Fayose cannot be an exception.”

      @Ethel, Where we’re you when former President Jonathan frooze the account of former Governor Murtala Nyako of Adamawa simply because he wanted to expose GEJ/PDP were the sponsors of Boko Haram??? Well Fayose received some of the looted funds from Dasuki. Please stop making caricature of yourself in this forum. People looted our funds with no shame. As far as Nigerians are concerned, the efcc are doing a wonderful job…

    What are you people even saying? His state workers are being owed salaries. People are suffering! He publicly announced he is joining them on strike yet suspicious transactions are being made.
    You think that is they didn’t have a good reason they will take the step? Abi they should wait till he embezzles all state funds and blames Buhari for not allocating enough money to them?.

      Is this not happening in many other states? Some APC states like Oyo, Osun and Imo have a similar problem or have had a similar problem. How can their governors embezzle brazenly, with no one calling them to order? I don’t have a good word to say to any governor, but there should be fairness.

      In Fayose’s case, he knows his antecedents and he just runs his mouth. He should have cooled down when he knows he’s not appreciated by the central government. How many other PDP governors do you see talking anyhow?

    I don’t get Nigerians ,and to think some people are actually defending him,which stupid immunity?!!! These man hasn’t paid salaries yet he has about 4 billion naira in his account !!! How?!! Even if he used just 1 billion it will have paid at least some months of their salaries and eased their hardship ,imagine the level of selfishness of some of these politicians! Some people are here defending him,smh ,Nigerians open your eyes and see that these useless politicians are taking us for fools!!!! Don’t let sentiments blind you from seeing this .

      I don’t understand your logic, who is being sentimental here? Do you mean that if a person has money in their personal account, even if it is their personal money, they should use it to pay government workers’ salary? If for instance, you are a business owner, and one of your businesses is not earning income, provided the company is a P.L.C will you use your own personal money to pay the staff’s salaries? I am not saying Fayose’s account should not be investigated, but your logic that he is expected to pay state workers’ salaries from his own account and not from the state government’s account is flawed…by the way, if you check the monthly allocations to Ekiti state, you would see that they actually didn’t receive enough money to cover the state overhead costs…..long story short, you should be the one thinking more logically, because you are clearly the sentimental one.

      oga didnt you read that EFCC has been investigating him since and that money is believed to be NSA funds illegally transfered into his account?. that is not his personal money. all the people that have been caught by the EFCC are they innocent? Name one?.with the way nigerians complain one would think these are people are angels.this is our common wealth them and their children are using to floss for us ,wake up for christsake!!

      If he owns businesses that generate the funds found in his account legally then he won’t have issues with EFCC. He isn’t even saying he hasn’t committed financial crimes he is trying to indict others to remove the attention from him. So maybe the present government is APC and Fayose i s PDP it still doesn’t justify stealing!

By the way, I am a Buhari supporter, but I believe it is okay to have opposing views, I also believe that Buhari is not perfect, he will make mistakes, and when he does, we will criticize him accordingly.

      That is such a myopic view you just expressed. So, everybody who criticised Buhari is the child of a politician? It is wrong to freeze the account of a sitting Gov. It does not matter if he belongs to PDP or APC. Fayose’s tenure will end in 2018 take him to the cleaners then. We should not allow partisanship to rob us the ability to speak up in the face of tyranny. What is not good is bad.

      The gov’s are not accountable to the President .All Sitting Gov’s hv immunity just like the President. One of the reasons is to ensure the Gov’s/President are not distracted by frivolities. I may not agree with the immunity clause but, the constitution is there for a reason. This is a democracy let us not tweak the constitution to suit individual needs.

It’s not out of any patriotism or overriding interest in the country’s good. Well, this nightmare is gonna extend for the next 3 years, deal with it!

      My brother we are talking of fairness. Imo state people are suffering and the governor have robbed them blind. Salaries are owed for months but he has nothing to worry about, he is APC. People are asking for fairness and not dictatorship. Fayose is not the only gov whose account should be frozen because he criticizes the president. If Nigerians keep quiet the Presidency will be bolder then we would have a full dictator on our hands. I believe nobody wants that.

      The question should be ‘ what does the law say in a situation like this’? I am aware that government officials enjoy immunity until the expiration of their tenure. However, If the people of Ekiti cannot stand Fayose’s alleged looting anymore, then the house of assembly should impeach him so he can be thoroughly prosecuted.
      We can’t keep acting like we have no laws governing us. If the immunity clause isn’t favourable anymore, then there should be a law to reverse it. All these selective unlawful prosecutions by the EFCC just makes rubbish of the good intentions of the present Government.

      Your government should be lauded for transparency. But my people will drown out the voice of reason with cries of ‘you benefited from Jonathan’s government and now that the well is dry you are bitter.’ God knows the truth, and those who have nothing to fear have nothing to fear. Those who are sitting pretty, beware because when judgment comes……it’s very swift.
