Nigerian Court Sentences Actor to 3 Months in Jail for Engaging in Homosexual Acts

In November 2011, the Nigerian Senate passed a strict law banning same-sex marriage and public display of affection by gays and lesbians in Nigeria.

According to provisions of the bill – Same Sex Marriage (prohibition) bill 2011 – a 14-year jail term is prescribed for convicted offenders in Nigeria.

“Persons who entered into a same sex marriage contract or civil union commits an offence and are each liable on conviction to a term of 14 years imprisonment.

“Any person, who registers, operates or participates in gay clubs, societies and organization, or directly or indirectly makes public show of same-sex amorous relationships in Nigeria commits an offence and shall be liable on conviction to a term of 10-year imprisonment,” it said.

The bill was greeted with widespread criticism from several groups as many said the Nigerian Senate should be focusing on other more important national issues. There were also protests from Nigerians already practising same-sex romantic relationships within and outside the shores of this country.

In the first major use of the provisions of the bill, a 28 year-old actor, Bestwood Chukwuemeka was on Monday September 17, 2011 sentenced to three-month imprisonment by a Karu Senior Magistrates’ Court, Abuja, for having sexual intercourse with another man through the anus.

Premium Times quoted him as pleading guilty to engaging in homosexual acts. “I am guilty of the charge against me. I  was under the influence of alcohol and I want the court to temper justice with mercy’’

The Police Prosecutor said the convict’s act was contrary to Section 284 of the Penal Code and that he committed the offence in August when sleeping in his bed.

Premium Times also noted that when he was first arraigned in early September, Mr. Chukwuemeka pleaded not guilty, saying, “I came back drunk from the night club and thought I was sleeping on the same bed with my girl-friend and I started romancing her.”

However, when the case was heard on Monday, the actor suddenly pleaded guilty, and was then sentenced to three-month imprisonment.

The Senior Magistrate, Nafisatu Buba, sentenced him to three-month imprisonment without an option of fine. “This would serve as warning to other youths who hide under the influence of alcohol to commit crimes,’’ she was quoted as saying.

Several questions arise here. What about the person he was supposedly having sexual intercourse with? How did the Police arrest him if he was in his bed at the said time?

I have no comments on this one. I think I’d just leave you to share your thoughts.

    Why does the Nigerian Judicial system insist on being barbaric and primitive? Who a human being is having sex with is nobody’s business as long as the other party is another adult consenting human being.

    The case here should be that he forcefully raped another person (i’m assuming it was rape since he said he just came and started touching the person he met on the bed) not whether it was homosexual or not.

    And if it wasn’t rape (i.e. if the person on the bed consented to his actions) then he should never have been charged to court in the first place.

    Go and arrest all the men in Northern Nigeria raping little girls in the name of marriage, no. Arrest all the pedophiles in Nigeria, no.

    It’s only homosexuals who are not harming anybody the Nigerian police know how to arrest and Nigerian judges know how to sentence.

    This country is just messed up.

    He deserves more than that in jail, what a disgusting, sickening act. Homosexuality is a sin, period. Just the same way rapists, pedophiles, molesters should all be punished. The Nigerian judicial system also need to make new laws against these men especially in the North who rape little girls and force them into marriage. These Northern men are notorious for sleeping with little boys too. So, rape is very common in that area and it’s sad that nobody is taking it seriously.

    If he raped the man in question, then he should be locked up. If it was consensual sex between two willing adults, then they should let him go. It’s things like this that make us a third world nation. How can we be compared to the likes of Congo and Uganda? As usual Nigerian’s will conveniently call it a disgusting sin, leaving out the part that says promiscous girls should be stoned to death and men shouldn’t shave ever.

    I find it disheartening that this is what this country has come to. Who are we to judge a man for sleeping with another man? Who are you to say it is wrong or right? People tend to forget that we are mere mortals and not God so the judgement of another human beings sexual orientation doesn’t lie with us. We should learn to be tolerant of people with different sexual orientation and quit acting like homophobic people.

    Being a homosexual shouldn’t be a crime punishable by law.

    As far as I’m concerned whether gay, bisexual or straight and as long as it is two consenting adults or individuals, love is love and a family is a family.

      Because the rate of child rape in Northern Nigeria totally eclipses the rate in southern Nigeria thanks to the predominance of child marriages in the north.

      No matter the level of poverty, girls from southern Nigeria are far more likely to stay unmarried well into adulthood than girls from northern Nigeria.

      And since there is no such thing as child “marriage” and only child rape (which is what it should rightfully be called) this is why every time the topic of pedophilia in Nigeria comes up, someone invariably mentions Northern men.

      It simply can’t be avoided.

      At least not as long as a SITTING NIGERIAN SENATOR is married to / raping a child and is still being allowed to parade up and down in the National Assembly.

    The law says if he MARRIES, or engages in PUBLIC display of affection with another man he should be punished. However, in this case, the act happened in his bedroom, so I don’t see why he should be jailed. As a Christian, I’m against homosexuality, but we should learn to detach morality from liberty and sense of duty.

    hi people. Homo sexuality has been prevalent in Nigeria ever since and there is nothing we can do to stop it except proper counselling. it has been reason why a lot of women file for divorce, people(mostly men) get into the act to get good jobs, money and attain big social status and even a lot of people in government especially northerners(sorry im nt being tribalistic) practice this for reasons best known to then. it is practiced man to man or man to woman so the government should not tag it as a crime except where there is no willful consent or where its a ground for divorce.

    Hello! can i get someones attention? the truth of the matter is that as christians we have to pray for everyone. No one is without sin, even the bible says that we are as a filthy rag before God that is why we ought to beg God for forgiveness at all times. The man has made his mistakes. Putting him in jail will not stop him from doing what he did. Rather the government would have had some sort of rehabilitation so that these people can be delivered. Because the lust after same sex isnt normal but a serious problem. Remember this was this same thing that made God upset in the time of Sodom and Gomorah.LET us pray: dear God, thank you for everything. Thank you for loving us even as we live in sin. please have mercy on us all. As many of us exchanging words in the process of this debate forgive us lord.     Why are Nigerians crying about this? Oh, this is what makes us a third world country. Please, acceptance of homosexuality will not automatically make us a developed country. Naijas, think by accepting everything the west does, we are moving forward. Let’s fix our infrastructure, economy, school system first then we will no longer be seen as third world country. Homosexuality, SHOULD NOT be widely accepted in Nigeria. It’s biblically wrong for same sex to have something that is intended between a man and a woman. Apart from moral aspect of it, the medical aspect is very important. It’s known that the fastest way to get HIV/AIDS is through homosexual acts, that’s what is killing Black Americans now is HIV/AIDS because of the high rise of gay men and also down low men who sleep with both sexes. I know, it’s also due to them not protecting themselves. So, emphasis on wearing condoms in this case is much needed, just like when men sleep with women. Nigeria, is barely dealing with other medical diseases like malaria, and to have a high rise of HIV/AIDS will not be a joke. We don’t even have a good healthcare system, medical equipments to care for that. I’m sorry, America is a country of freedom, where anything goes but it’s important for the Nigerian society to stick and raise our children in a man and woman relationship. I support the law against homosexuals, only bcos it will make them keep whatever they do privately instead of flaunting it around. I know, they are gays in Nigeria, bcos homosexuality is a sin and everybody sins. My only problem is, it SHOULD NOT be widely okay in the society. If we are going to have this law, we also have to emphasize on people who commit huge crimes everyday and make sure justice is being served. It’s just for three months, he will be out soon. Can they arrest all the other criminals who do worse things than this?

    People have said so many hateful things in the name of religion. People have ‘cast the first stone’ all in the name of Christianity. We seem to forget that as Christians we aren’t suppose to judge a fellow human being. We aren’t suppose to say hateful words to our fellow human being. We aren’t suppose to condemn our fellow human being.
    We are suppose to love people who are ‘different’ and allow them live in peace with us.
    We are suppose to mind our business and let God do His work. He isn’t handicapable . He awesome and almighty.
    God love us all whether we are gay, bisexual or straight. What he hates is sin not the individuals committing the sin. So please lets orientate ourselves to see the good in people.
    If you are ignorant about homosexual relationships, you either educate yourself or mind your business. But to be so hateful of an act you know nothing of speaks volumes about your person.
    I have learnt to live in peace with all men and women. To me, it doesn’t matter what your sexual orientation is. Whom you chose to love is your business and I respect individual choice.

    Yes, we are suppose to love everybody but keep in mind, God is love and also a judge. So, let’s not mix everything up now. God hates sin, he loves you but doesn’t excuse the fact to continue to sin with no repentance.
    Just like a parent love his/her child, but there’s also time to scold, disagree and correct. And, just bcos you love your child doesn’t mean you will allow him/her to do whatever and not care. That’s the same with God, he has rules/standards that we that are his true followers has to follow. If we fail to, there’s consequence.
    For goodness sake, can people stop equating disagreement or holding on to one’s values as ignorance. So, bcos I don’t agree with the homosexual lifestyle, I’m ignorant? No, people who claim to be christian and think God is okay with continuity of sin are simple ignorant. If God loves us so much he will let us do anything and there won’t be good or bad. So, in the name of people trying to be tolerant of anything, there are some people out there who are still holding on to their values, and there’s nothing wrong with that.

The problem is when done outside of marriage which is more biblical. Sex between same sex is abnormal, it’s been proven biologically and scientifically. Yes, no sin is bigger than the other but let’s be realistic here, if a boy and a girl have sex it’s okay based on human standards but when an adult has sex with a child, it’s wrong, when someone is touched or forced to have sex without their go ahead is wrong. So, at the end of the day, even ones that don’t want to go by the Bible have some type of human standard, morals they still go by. And, homosexuality falls into that category. I agree, Nigerian justice system needs to do more and not just focus on homosexuals but also focus on other important topics like rapists, pedophiles, criminals etc.
