Don Jazzy vs Wande Coal! Music Producer claims Afro Pop Star Stole his Song “Baby Face”

It seems all isn’t perfect after all in the Mavin Records camp.

In July, BellaNaija Music brought you the story that Afro Pop/R&B star Wande Coal may be exiting Mavin Records (click here to read), the record label founded by music producer Don Jazzy in 2012.

After the release of Wande Coal’s video “The Kick” which had no indication of Mavin Records, but Wande’s record label Black Diamond Ent., the streets started talking.

Today Tuesday 5th November 2013, Wande Coal released a fun upbeat track titled – Baby Face.

A few minutes ago, Don Jazzy took to Twitter to state that he is the rightful owner of the song. In one of his tweets, he claims that he produced the song a year ago.

Mavin-600x600 Mavin Records was founded by Don Jazzy, after his split with long time business partner, D’banj. Mavin Records was officially unveiled to the public in May 2012, with artistes such as Tiwa Savage, D’Prince, Dr Sid, Don Jazzy and Wande Coal. Wande Coal’s profile has been removed from the label’s official website – Listen to Wande Coal’s Baby Face Listen to Don Jazzy’s Baby Face Update: Wande tweeted the version he says he recorded with Don Jazzy last year. 

Case closed? We’ll see.

    This is all looking like a grand publicity stunt orchestrated by Don Jazzy. This just make you wonder if the Mo’hit/D’banj saga wasn’t staged. I see a trend here Don Jazzy!…

      @Concerned_Boyfriend you may be right, I also think it’s a publicity stunt. The music industry is now so huge that Wande is not finding it easy to gain relevance, irrespective of the fact that he is very talented. I believe this ”Babyface” track issue is a publicity stunt for Marvin acts and Wande to gain more relevance in the industry. I sincerely hope I am right, they just need people to be curious and create controversy such that they will all be in the news. Let’s keep our fingers crossed

You go on twitter like a kid and start blabbing , you can call his phone or a dime, the motive for this is bring him down but there is no maturity in this , you are sad and better that he is moving on well.       DonJazzy was Right! its common sense that WC stole the song from his tweets, he is really ashamed that Don Baba J told the world the truth… just like as you are hungry, you eat, you are thirst, you drink, this is a feeling, the Don was angry and spoke about it, he is lucky he didn’t take action.. DonJazzy is Africa’s best! Believe that!

      Nigerians can’t recognise the fact of theft because it’s become the normally acceptable order of the day. Case in point – their governors are robbing state coffers with impunity. Some impoverished citizens defend the criminal-in-office by rolling out this rebuttal “But he’s not the first and he won’t be the last”. If they can forgive the theft of tangible items so easily, what do you imagine their attitude will be to stealing intangible goods? The mental slavery which yokes their intellect has become a very real issue.

      there was nothing to Don’s claims. kai so if I have $1m and i work
      for another 50k, i shouldn’t talk if someone takes the 50k? anyway
      all these contract/IP cases are really good for Naija lawyers.

    I see no difference between donjazzy ‘s original and wande ‘s version. Wande should have given him his credit though,and I noticed this Shizzi guy likes to work with others stolen songs and then attach his name to it. Donjazzy shouldn’t have brought it on twitter but wande knew better not to credit him..anyways na so be music business, Nigeria should create a law about intellectual property to stop this from happening.

    Wande Coal was wrong here, Don Jazzy wrote a song and the next thing the song is released without any credit giving to him, even if Wande Coal fell out with Don Jazzy he would have at least called before releasing the song or even give him credit how would you feel if after doing a course work in uni your friend copies the same course work and gets credit for your work, obviously you would feel bad so my people please dont blame Don jazzy completely he was mad that is why he took to twitter and is not like his asking for too much at least Wande give him credit and stop making him look like a bad person cause you are the selfish one here who thinks his smart.

    For those of your that thought Don Jazzy wrote the song, I’ll humbly disagree with that assertion. Don Jazzy was never known to write songs, he’s a producer not a song writer. Wande was the songwriter in the group. This was well documented on D’banj’s album, Dr Sid’s album and D’Prince’s album. My guess was that Wande wrote the song for Don Jazzy but decided to release the same copy on his upcoming album..The beat no doubt sounds like the original beat posted by Don Jazzy

    All these artist need to understand the complexity of the contracts they sign in this industry because it’s just pure monkey banana standard practices. Half the shit people do here as artist who are signed, they can never get away with such if they are signed to an international record label. Soon as money gets flashed they sign without reading fine prints. Now when it comes to intellectual property in a song, these boys need to first understand copyrights, n who own the actual composition of the song. If it’s a jazzy song, n he has d demo to prove it, then technically he should be credited for it. Now only time will tell who actually owns the song. Meanwhile all this twitter hog wash, it’s just silly. We can cuss jazzy n Wande all day n pick sides but truth is, a man who owns his house, would never let a tenant claim ownership

    how do we know who did the recording first – none of the recordings have any authentic time stamps on them. I may as well upload same song and claim i produced/wrote it two tears ago. If a crime has been commited – get your lawyers involved and sue !!

    I actually prefer shizzy’s version. he reproduced. different key and all. wande’s voice made me smile. jazzy’s version, key dropped. heavier. but didn’t have that goose bump baby feel wande’s had.

      What is the song without the beat? This is the silliest argument I’ve heard? let him go write poetry and leave DJ music alone then. Go see how much people like Kanye, Ryan leslie, Timbaland make just from beats. If you use somebody’s work, even if it is a fraction you have to give them credit.

    This is the problem! I’m reading and first off it’s not for anyone today who’s right or wrong- only only the two people that worked together in their relationship know what really happened! And what is the loyalty that Wande has given? Like this stupid sense of entitlement just baffles me! So if I work for GTB for 10 years, I can carry the computer I works with, cus I have been loyal! What is loyalty, didn’t he have a salary? Didn’t he get commissions? I don’t get it! We all know how hard it is to contact someone that say borrowed something from you and perhaps broke it or lost it, ppl suddenly don’t see your calls or messages! Blame Don Jazzy call him names, but if he had taken legal actions you same wagging tongues would say, he’s a bully!     If I’m being totally objective, WC sounds good on the song but the lyrics (“…I confess that I have big nose”) and style of the song seem to be intended for Don Jazzy. Also, the timing of the release – right after Tiwa and Jazzy’s Eminado- seems a bit questionable. #i’mjustsaying

    I read the entire exchange on LIB and Wande Coal is very wrong! Don jazzy going on social media is even a show of clemency! Apparently before this song there was Rotate that was stolen as well. So at this point I figure that Don Jazzy gave him plenty opportunities after releasing ROTATE (without MAVIN credit) to come forward and do the right thing but he chose not too and now when Don Jazzy decides to embarrass him publicly he wants to take the high road?
    Don jazzy makes his money from his work, so just because he is Don jazzy he should now be dashing entire albums to people?
    Let’s get real. he could really have pulled a chocolate city here, all he is asking for is credit. And credit is due.
    If it was Wande’s first offense I’d say it’s out of proportion but there was the kick, rotate, and now this one.
    If you wanna use somebody’s work, you go and ask for permission, it it not the other way around. they should not follow you to get their credit, you should ask for it. Wande is dead wrong on this one. This has nothing to do with loyalty or whatever. I think letting hom get away with The Kick and Rotate were the thank you.

    Contract law should be made compulsory in uni… The kind of sentimental hogwash people employ when they breach a contract is just annoying. No sentiments in business, if the song belongs to don jazzy, give him his due…if not say so! All this talk of 10years servitude begs the question, who forced you? Were you a slave or did you get compensated for yor servitude ? Brymos gist has died down , people will soon forget him and move on! I would be shitting bricks if someone steals my intellectual property and credits it to another!

Don Jazzy is not a kid so for him to have brought it on twitter, I want to believe he tried communicating with Wande but Wande must have been feeling smart.     Bringing your grievances to the public is always a bad move. If there is actually a case, then he can take it to the courts. What will this twitter feud solve?     In this situation, both songs have the same lyrics and very similar beats. The question is….who wrote the lyrics? Is it Wande, Jazzy, or some other song writer? It’s quite obvious that Don Jazzy made the original beat, but who was it made for? Was it for Wande Coal, who was an artist under Mavin Records at the time, or someone else? If the beat was for Wande at the time, was there a release clause on Wande’s terms of leaving Mavin records that prohibited him from working on unfinished songs? In other words, Does he have rights to all his songs, both finished and unfinished?

    These are some of the questions that come to mind while dissecting this issue. An honest response to the questions will determine if indeed Wande unlawfully used Jazzy’s intellectual property without giving Jazzy his due credit

      I agree with you. We need answers to these questions before we can judge anyone. None of their tweets gives us a real picture. All these playing to the public gallery with emotions is not cutting it.

    What is all this talk about Wande being loyal and serving Jazzy for a almost a decade? Abi na apprenticeship for Idumota? Because you served someone for a decade, you automatically earn a license to steal? I am always wary of twitter and its inhabitants but it is slightly silly for Wande to suggest ways Jazzy should contact him. Did Jazzy recommend ways Wande should use in displaying the stolen content? I am just pissed that they are fighting over a crap song.
    The Nigerian music industry needs a clean up. It is lacking in sanity. All this lawlessness can not go on forever.

    I’m now scared of Nigerians … I’ve listen to both songs, they sound too alike … they may not be the exact same thing but haba na !!!
    its Obvious WC made the song originally with Don Jazzy, all he had to do was @ least give him credit for the song … The Demo was what the new producer listened to & modified a beat from it …. it would have been very simple to Give both Don Jazzy and new Producer credit for the Beat with Don Jazzy’s name first since he did the Original demo.

    This is a legal matter and not one that can be solved on twitter. Don Jazzy is well within his rights in this matter from a legal point of view, Us Africans have forever overlooked the law and just do as we like. Wande on the other hand I must say is very foolish to compare those two songs and actually believe that there is a difference. I mean..what was he drinking at the time?? Instead of making a fool of himself in public he should be given his lawyers consent to come to some sort of agreement with Don Jazzy’s legal team. My advice on the whole matter is that they should now leave twitter and discuss this in private like men and especially for the fact that they had a great working history together over the years.

Intellectual property is worth a whole lot more that dollars and cents. It’s sometimes the source of residual income.     After i Listened to the lyrics of Babyface of both Don J and Wande, it more of by Don J, most words there are in Igbo and he pronounced them clearly well. Checkout Verse 5 ” Shit is big and no one knows, i confess cos i get bit nose>>>>>” Verse 6 “ukwu nwanyi ghara oto>>>>>>>>>” WC could not decode the words so he just forged a meaningless ryhme there.     I know that in record label dealings singers use the idea of their bosses both the music and the production and have no any means of problem because they know is all comming back to them as profit. I think for this WHACKED musician call Don Jazzy should even be grateful Wande is promoting ugly voice which we have been managing because of the talent he has around him not because he has done something special that no body is doing now. We have number of producers who are producing musics to many talented artist at the top now who are beta than artist under Don Jazzy and they are this problem as much, so let Don Jazzy parked his piano if he don’t have anything to offer again cause is obvious Chorps are murdering his beat
