Mercy Aigbe has threatened to sue both the designer Rikaotobyme in the red dress saga and the bride.

In a letter addressed to the bride’s lawyers Capitalfield Attorneys, Aigbe’s lawyer, Nwokeji Ibeakokwu & Co., threatened to sue both the bride and Rikaotobyme for defamation of character.

The bride’s lawyers had on Tuesday made public a letter threatening to sue both Rikaotobyme and Mercy Aigbe to court.

Mercy Aigbe had no contact with the designer, the letter said, as she had contracted a stylist StyledBySeun to style her for her birthday shoot.

The accusation that there was a “deliberate and fraudulent conspiracy” between Rikaotobyme and Mercy Aigbe by the bride’s lawyers was termed as a “malicious allegation.”

Aigbe’s lawyers have asked that the bride tender a public apology, much in the way as the public threat to sue, absolving their client of all blame.

If the apology isn’t tendered within 7 days, the lawyers wrote, then both the bride and the designer will be taken to court for defamation of character.

    I agree, the bride has no business suing Mercy, it was the designer she paid to make a dress for her, it was the designer that disappointed her and gave her dress to other people to wear!

    Mercy is as guilty as the designer. When the bride first raised the alarm about the dress she should have issued a statement immediately and pulled down her picture. This just like one buying stolen goods. I feel Mercy is using offence technique as her defense mechanism which will not favour in the long run.

      What if the allegation is false is what will be going on in your head and even if it’s true, you will be like ‘ki lo kan mi’, l bought from dealer’
      Let’s be objective on this matter and don’t defame the poor actress’ character

    My blame is on the bride’s counsel. Common sense shows that the breach of contract is between her and the fashion designer and mercy aigbe should not be included.

      But she was the one that was found with the ‘stolen goods’ so she must present a statement for the court. And the court will decipher the truth. One can’t just rely on her word that it was all handled by a third party – i.e. the stylist.
      It was evident it to her and many others it that the dress was dishonestly appropriated so she should have taken it down from social media until the matter was cleared not continue to flaunt the goods (red dress) on social media without a care in the world.
      She acted dishonestly and it was not the reasonable expected behaviour of one who has come into the possession of ‘stolen goods’.

    Anyone saying Mercy should be sued because she did not take the picture down or some other flimsy excuse doesn’t know anything to be honest. Her stylist made a transaction on her behalf as a client and she should be sued? Why didn’t you ask for the stylist to be sued? Because you have an already established malicious bias against Mercy Aigbe. Don’t bring that into this case. She is guilty of absolutely nothing. I’m so happy she has presented a countersuit. Una go see where this go end. P.S- For all the naysayers and rubbish skewers I don’t know Mercy Aigbe personally.

      For all it’s worth Mercy is greedy and lacks integrity. Any sane and self respecting person or yeyebrity that she is ought to have pulled down this picture from her page immediately the scandal broke. But, the greedy woman, I must slay by Force hasn’t. What does that say about her Xter???

      At the time of the saga broke, all we heard of was the Bride vs the designer and Mercy. Mercy later found a scapegoat to throw under the bus… she needs to explain herself.

    Why won’t the bride join Mercy as a party in the suit, when it was Mercy that was found wearing the stolen dress, which the bride bought the material by herself… What Mercy has done is social media tale … She should go to court and make the same explanation and let’s see if the truth won’t surface during Cross Examination, coz both her, her said stylist and designer having been telling inconsistent and contradicting stories … Guess, she is trying to intimidate the bride by threatening a Counter suit… She should bring it on, except the bride’s lawyers don’t know their onion…

    I am not a lawyer, but I think Mercy may be culpable and the onus is on her to prove she did not know the dress was fully paid for by someone else. If the bride is able to prove that Mercy was aware the delivery was time-sensitive, yet went ahead and ‘borrowed’ the dress, then I think she may have a case to answer.
    Please correct me if I am wrong.

    Mercy is so greedy and lacks baseline credibility that I just can’t imagine she didn’t cohort with the tailor to borrow pose with that dress. She is always borrowing dresses, wigs and jewelry to flex on the gram. Her ojukokoro and desperation is the reason she would squeeze herself into a dress that couldn’t be zipped up in the back.       We all dont have full details of the case. So let us not be judges. But no matter how the matter is viewed, the designer is in deep shit. Asides this bad publicity for her business, her credibility is dead titi lai lai.

      Do you know Mercy? Have you had any previous business dealings that turned sour? Did she steal from you? Have you ever met her? Did you ask her to be friends and she declined ?

      You see I ask all this questions because you are up saying she s greedy and lacks credibility, are these allegations based on your experiences with her or you just feel like doing some character assassination. Take it easy o, life is not that hard.

    Madam Mercy, if you were sensitive to the bride’s plight you would have respected her tears by taking down those pictures. The world has seen you in the dress, the internet would still save the picture of you in that dress, you would have still had copies of the picture in your coffers but you would have done an honourable thing in showing sympathy for and solidarity with the bride against a heartless and greedy designer who lies through her teeth. Now you want to save your name by suing a bride who has already been through so much emotional turmoil. Did you ever imagine how she felt seeing you in a dress that should have been her wedding dress? Do you know how much she had imagined herself in that dress on her very special day? When you released your statement to absolve yourself of blames, did you even reach out to the bride privately at least to share in her pains? I’m sure if you did that she wouldn’t have sued you but again what do i know?

    Leave Mercy, she’s too busy trying to save face. Her lawyers must be a group of novices. The bride’s lawyers must double down and maintain their stance. Mercy is a celebrity, the expectation is for you to take a chunk off the humble pie and swallow it hard. You are supposed to be a role model. Okay oh. We shall see. This is leaving a bitter taste in my mouth and is beginning to put me off Mercy as an actress. Wow!

    This is basic contracts. Legally, Mercy Aigbe is also culpable in this matter and should be sued. To a layperson, I will explain how.
    The Law of Agency deals with a set of “contractual” and “fiduciary” relationship that involve a person, called the “agent” that is authorized to act on behalf of another, called the “principal”. The agent is able to negotiate on behalf of the principal with third parties in contractual agreements. An agent can have express authority, implied authority or apparent authority.

    In this case, Mercy alleges that she should not be sued as she hired the stylist, “Seun” who contracted with the designer “Rikataobyme” to style her for the photoshoot. That will make Seun an “agent” and Mercy the “principal.” Therefore, Seun had some sort of express or implied authority to act on Mercy’s behalf. If Seun can prove that she had express authority from Mercy to get that particular dress or that Mercy was aware, Mercy as the principal is liable. Mercy cannot argue that she is not liable because it was Seun who did all the styling because Seun, as an agent acted on Mercy’s behalf. Seun contracting with the dress designer was within the scope of their agency. Mercy’s defense can only be that Seun did not act with due diligence.

      Utter rubbish! Go back to, if you have been, to law school, and read the case again objectively. It should still be here when you are through. Stylist alleged that he or she went to designer’s store and picked up 4 dresses. Not 4 specific dresses previously discussed. Designer has not countered that allegation. So where does your opinion fit?

    1. Mercy is counter-suing, that’s usually what people that are innocent of the said accusations do.
    2. I understand the bride’s situation, however I believe she should face the designer in question and leave Mercy out of it.
    3. Why are people so quick to persecute Mercy, making up scenarios in their heads, conjuring up facts when in fact none of us know exactly what happened. Because she is famous, she is automatically guilty abi?
    4. No one died, so people please.
    5. Let them all have their day in court.

    This move of suing a bride whose sweat and dress was robbed is a wrong move .

    Mercy this shows no empathy on your behalf.
    Haba Mercy , yours was birthday hers was wedding.
    Material she bought by herself with her own money, efforts and sweat.

    The bride was suing Rikaotoole, somehow your name had to be mentioned because you wore the dress.

    Infact, I recollect the designers apology , in the statement : Rikato first apologised to mercy not the bride.

    Mercy , in this whole saga. The bride is the one who was badly treated the most .
    And if she keeps seeing her dress on you on instagram, and wore a rugged dress on her big day , she has every right to be upset.

    Mercy you refused to take off pictures with the dress on your page despite millions of other nice pictures and dresses you have on your page.

    Mercy you never apologised publicly to the bride.
    But immediately she sued, you called your lawyers.
    Am not with you on this mercy , do not let fame mesmerise you , have you no human feelings? . jeeez ….
    Rikato should speak out now . then the truth will be unveiled. Rikato this your only opportunity to air the true situation.

    @KB, Thanks for introducing the agency theory, makes sense but would that apply if this supposed Seun was acting as an independent contractor? Either way, it’s called lumping. Just pile all possible defendants up and let everyone plead their case. At least one person will be found guilty and will pay. Hopefully the bride’s lawyers have contacted “Seun le/la Stylist(e).”

    Mercy should be ashamed of herself. Whatsoever a man sow he shall reap. There is karma Mercy aigbe. You wore this bride’s dress that was meant for her wedding, you refused to issue a statement and went ahead and had your party like nothing happened. You still left the picture as your DP on instagram welithout any feeling of guilt or shame and you still have the gut to counter sue? Girl you are mean.. you’ve had your wedding but your daughter hasn’t…. I leave it at that and before I forget, you owe the said bride a sincere apology and go back and work on your marriage. Yeyebrity!!!!

    Am wondering how Mercy and her lawyers intend to pull this defamation stunt off. The lawyers committed a big blunder by saying that Mercy had no interaction with the designer (Rikaotobyme). She didn’t know her yet she (Mercy Aigbe – not Segun) tagged her on instagram. In law, truth is a complete defence to defamation. The disappionted bride has not made any fabricated remarks – she told the whole world the truth and its rather a pity that Mercy was caught in the web of all this. These lawyers dont have a case and Mercy had better become the mature person in the room by taking down the pics on all her social media platforms and calling the aggrieved party to a round table discussion. All the legal tussle would only dig up more dirt and insults.
